It may well be, but there is the matter of Page 101 Schedule 2 Point 3 Release of the Standstill Undertaking.
If I were in MLM's position, I'd be using this as a bargaining point. Improve your offer eg. 2.3319 DRX shares for one MLM share.
Unfortunately this detail is not in your face when first reading the Offer and most shareholders eyes would have glazed over by the time you got to Page 101.
