It's Justice Lee's job to sort though the facts and the lies and come to a decision based on fasta available and only has to find probably likelihood.
As he said himself his decision wasn't to be taken as meeting a criminal trial decision of beyond reasonable doubt. This was a civil matter, so maybe that detail wasn't as vital as you're making out?
