Lehrmann went to the court, dragging others into a matter at the cost of millions. He was the one requiring a decision on the matter. The state had no interest in what was a dispute between citizens to which Lehrmann sought resolution at the judicial level. Had Lehrmann not required a decision, the courts would not have made one.
