thansk for the info ausheds, as I'd written in my original post I took a lot of the background info from various sources and a bit from the SMSL site to try and maintain an even keel as to the scope of what was being argued about.
From what I can gather, and given the intense scruitiny LYC is experiencing, their handling of this waste will have to be second to none and they just aren't going to drop the ball and risk partners in Malaysia losing face or not even money can buy them out of that kind of problem politically.
I get the feeling these guys are very solid operators and this will be very much valued in dollars rather than cents as a longer term play
