Due to the repetitive nature of both your posts, it is simpler for me to reply in one post.
Yanukovych made a series of poor decisions. Neither the EU nor the US were involved in those.
Yanukovych planned his departure. He executed his pre planned departure. He could not be contacted. He did not inform of his whereabouts. He had one departure attempt blocked.
Not the actions of a man intending to stay on as president.
The constitutionality, or not, of the situation created by Yanukovych and his abandonment of the presidency and departure from Ukraine is irrelevant. General elections held mere months after he left voluntarily solved that.
A bank robber planning a bank robbery who is caught is still committing a crime. Just because Yanukovych hadn't manged to exit Ukraine while executing his plan to leave Ukraine still means he intended to leave. He gave away his presidency. Simple as that.
