Judging from what I have seen of the relevant CCTV clip I doubt thatthe lip reader can be certain to the required degree that he hascorrectly identified what Bruce said. He took three days of viewingto decide what had been allegedly said. It was clear from hisevidence that he had formed an opinion about the incident on theCCTV. He is also a paid witness. I expect that Whybrow will get acouple of expert lip readers to refute the evidence. Further, I don’tthink Justice Lee will think much of it, particularly if other lipreaders have alternative readings.
